An official plan amendment and zoning by-law amendment application was submitted in June 2021 for a proposed 24-storey residential development containing 223 units, located to the south of Brown Junior Public School (454 Avenue Road). In May 2022 the developer filed an appeal to the Ontario Land Tribunal (OLT) on the lack of decision by City Council on the applications.

TLC identified land use planning concerns related to shadowing of the Brown Jr PS property, and secured party status at the OLT. As a party to the OLT case, TLC were involved in formal mediation with the developer and City. TLC has executed minutes of settlement with the developer to secure a reduction in building height in order to reduce shadow impacts on the school.
