An Official Plan & Zoning Bylaw Amendment application was submitted to the City of Toronto in October 2020 to permit a 9-storey mixed-use building with commercial and residential uses, as well as a 4-storey standalone rental building, fronting Birchcliff Avenue.

In late 2021, the developer filed an appeal to the Ontario Land Tribunal (OLT) on the lack of decision by City Council on the application.

The proposed development is located on the south side of Kingston Road, across from Birch Cliff Public School. TLC identified potential shadow impacts that could impact the school’s outdoor play space. TLC has obtained party status in the appeal, to protect the usability of the Birch Cliff Public School site.
