An official plan amendment was submitted in March 2017 and a new zoning by-law amendment submitted in September 2020 for a proposed 821 unit residential development of 30 and 45 storeys, connected by an 8-storey base building, located to the west of Davisville Junior Public School (43 Millwood Road). The developer filed appeals to the Local Planning Appeal Tribunal, now Ontario Land Tribunal (OLT) in May 2021 on the lack of decision by City Council.

TLC identified land use planning concerns related to overlooking, traffic and construction safety with respect to the Davisville Jr PS property. Furthermore, the proposed development is located in the Midtown Area, a community experiencing residential intensification and population growth that is presenting significant pupil accommodation challenges at all local elementary schools.

As a party to the OLT case, TLC were involved in formal mediation with the developer and City. TLC has executed minutes of settlement with the developer to secure restrictions on balconies overlooking the school’s outdoor play space, barriers and screening requirements for east-facing terraces, traffic movement restrictions from the development past Davisville Jr PS, and boundary/fencing requirements between the school and subject property. Development occupancy timing was also secured in order to reduce student accommodation pressures.
