A zoning by-law amendment application was submitted to demolish an existing place of worship and construct a new place or worship and a 44-storey residential tower containing 398 dwelling units. In 2020, the developer filed appeals to the Local Planning Appeal Tribunal, now Ontario Land Tribunal (OLT) on the lack of decision by City Council on the zoning by-law amendment application.

TLC identified concerns including shadowing on the John Fisher Junior Public School site, and health and safety concerns due to demolition and construction. Furthermore, the proposed development is located in the Midtown Area, a community experiencing residential intensification and population growth that is presenting significant pupil accommodation challenges at all local elementary schools.

As a party to the OLT case, TLC has executed minutes of settlement with the developer to secure occupancy timing to reduce student accommodation pressure in the area. A settlement has been reached between the City and developer based on a revised proposal of 39-storeys, which reduces shadow impact on John Fisher Public School.  TLC staff to review site plan application and monitor to ensure compliance with settlement agreement. TLC will also request the Construction Management Plan for review, to ensure safety of students, particularly those attending North Toronto CI, is maintained.
